In Hornsby v Greece, the ECtHR held that the Greek non-compliance with an ECJ judgment was a violation of article 6 of the ECHR, as access to court would become pointless if a state violating EU citizens’ free movement rights were allowed to simply ignore the ECJ preliminary ruling on the issue.
