De ce este protecția drepturilor fundamentale, în materie penală, mai puternic garantată la nivelul CJUE decât la nivelul CEDO

The ECHR’s relevant procedural guarantees – if they are adhered to in practice – offer only a quite general minimum level of protection and do not guarantee consistent standards across EU Member States. Moreover, the ECtHR can only be appealed to once domestic remedies have been exhausted. In this regard, the protection of fundamental rights at the EU level proves itself stronger, as a case can be referred to the CJEU while proceedings are still ongoing and thus national practice can already be monitored at an early stage.
