Funcția constituțiilor moderne nu este doar limitarea puterii publice, ci și constituirea ei

The function of modern constitutions, moreover, is not merely to limit public power but also to constitute it. The modern process of political self-constitution can intelligibly be regarded as „the constitution of a political unity through a legal order, not as the constitution of a legal order by a political unity” (cu trimitere la Vinx, The Incoherence of Strong Popular Sovereignty (2013) 11 International Journal of Constitutional Law, 101, 103).
